[Historic Cemeteries]

Hello,

 

Our cemetery charges an administrative fee of $ 150 for each interment in
our cemetery.  The fee can be described as opening closing of the grave,
cost of inflation, etc.  We've been receiving this fee from a particular
funeral establishment for over 10 years.  Lately, they've decided not to
collect and re-mitt the fee to our or any cemetery.  I've found no Oregon
citation that regulates the collection of this fee by a funeral
establishment or for a cemetery to enforce payment.  

 

Specifically, Oregon Revised Statute 97.710 (b) grants power for a cemetery
to make rules and regulations restricting and limiting the use of all
property within its cemetery.  Perhaps a way to enforce payment is to not
allow interments by a specific funeral establishment.  Of course the last
avenue if there are better ways.

 

Does anyone have ideas on how to establish a procedure our plan that assists
a cemetery in collecting this necessary fee?  Any Oregon law citations?
