What does it mean to make a finding within a 'reasonable medical certainty'?  Can you define it, and if so, is your definition consistent with that of your team members?
If you struggled to answer these questions, or to find consistency among answers, then you are not alone.  In fact, it is exactly because of this struggle that researchers conducted a study and published the results in a recent article entitled "Defining 'reasonable medical certainty' in court:  What does it mean to medical experts in child abuse cases?<https://t.e2ma.net/click/topot/lqlgrj/tgv79f>"
The researchers developed a "28-item survey... to determine how the term 'reasonable medical certainty' (RMC) is interpreted by professionals who treat and/or diagnose (alleged) child abuse, and who thus are called upon to testify in court."  Id<https://t.e2ma.net/click/topot/lqlgrj/98v79f>., p. 2.  The survey asked respondents the following:

  *   The estimated numerical probability that abuse had occurred;
  *   The estimated ordinal probability that child abuse had occurred; and
  *   To which of three legal standards ('preponderance of the evidence', 'clear and convincing evidence', or 'beyond a reasonable doubt') their RMC definition most closely mapped.

Their answers were illuminating.  Although 95% of the 256 respondents reported having provided expert testimony in court cases involving child abuse, they "expressed varying degrees of comfort with the term RMC, [and] only 37% reported feeling comfortable with their definition of the term." The researchers noted that "the lack of a standard legal definition of RMC likely accounts for the variability among the respondents."  Id<https://t.e2ma.net/click/topot/lqlgrj/lmy79f>., p. 7.  But "judges, juries, and the public at large may mistakenly believe experts are employing a well-defined professional standard when, in fact, none exists." Moreover, the researchers found inconsistencies as between different medical specialties, which the researchers attribute to "[c]ultural differences... among the various specialties.  As pediatricians, child abuse physicians are trained to care for children holistically and within the context of their families....  So it is perhaps not surprising that many more pediatricians (59%) reported needing a >95% probability before RMC was reached/declared, compared to neurosurgeons (30%) and forensic pathologists (37%) whose orientation may be more focused on the injury at hand." Because there is no standard definition of RMC, the definitions among various legal treatises are all over the map.  And while "the law is clear that RMC and courts' evidentiary standards are two entirely different and unrelated entities, and that the definition of RMC that a witness uses should be unaffected by either the charges of the evidentiary standard to which jurors are held ... logic dictates that the two standards are in some manner linked.  One assumes that a jury would want to know if the standard to which the experts are testifying matches the standard they themselves will consider in their deliberations." What is to be done with this dilemma?  The authors suggest that, until there is consensus about the meaning and application of RMC, "courts may do well to either avoid such language altogether, or to ask each expert what they mean by the term."  Id<https://t.e2ma.net/click/topot/lqlgrj/ds179f>., p. 9.  Experts could also be asked the following three questions to further clarify their understanding of RMC:

  *   Compared to other possible explanations for this child's condition, is it your professional opinion that child abuse is the most likely diagnosis?
  *   Based on your knowledge and experience, along with the evidence presented in this case, how likely do you estimate it is that this child was abused?  And
  *   The jury is being asked to determine the probability that the defendant in this case abused the child; are you able to testify that the likelihood of abuse meets or exceeds this probability?

I strongly recommend that you download this article and read it in full, and that you share it with your MDT members - particularly those in the medical field and the prosecutors on your team.  Often, child abuse cases hinge on medical testimony - but the importance of that testimony must be weighed against the potential for injustice.  Finding this balance will protect our children and the integrity of the process.

The first review of applications will take place on January 15, 2016.The Intake Coordinator is a core member of the Clinical Team, receiving referrals to Liberty House, determining services needed in consultation with the medical staff, obtaining relevant  records and documents, scheduling assessments, and fielding questions from caregivers and partners. This position reports to the Clinic Manager.

*         Pay range: $20 - $22 per hour, depending upon experience.
