Victims Don't Have to Choose;
They Have Rights to Privacy & Restitution
This week NCVLI led an amicus curiae effort that brought together 8 co-amici to protect a victim's rights to privacy, confidentiality and restitution. After defendant pled guilty to stalking, the victim requested restitution for counseling costs. Despite substantial evidence supporting the request, the court then granted the defendant's request to review the victim's private and confidential mental health records! Amici joined to fight the court's error, arguing that if the ruling stands it will create a dangerous precedent by placing victims who seek restitution in the untenable position of possibly sacrificing the very protections that make services effective: privilege and confidentiality. No victim should have to choose between their rights - they deserve all of them! Justice Department Releases Protocol for Child Sexual Abuse Forensic Examinations
On April 28, 2016, the Department of Justice's Office on Violence Against Women<https://n1.m.tt/a/gptkdspqeq-ujmgqjdd.html?utm_source=DynamicsMarketing&utm_medium=Email&utm_campaign=JJUVJUST_PediatricSafe_050416> (OVW) released "A National Protocol for Sexual Abuse Medical Forensic Examinations-Pediatric"<https://n1.m.tt/a/gptkdspqep-ujmgqjdd.html?utm_source=DynamicsMarketing&utm_medium=Email&utm_campaign=JJUVJUST_PediatricSafe_050416> (Pediatric SAFE Protocol). In 2004, OVW partnered with the International Association of Forensic Nurses to release a national protocol on responding to the immediate needs of adult and adolescent sexual assault victims. The new Pediatric SAFE Protocol provides evidence-based, trauma-informed recommendations for health care providers who conduct sexual abuse medical forensic examinations of children. It offers guidance for professionals and agencies-including law enforcement, prosecutors, crime lab personnel, victim advocates, and child advocacy centers-for facilitating medical forensic care when working with health care providers in cases of sexual abuse of children. Assistant Attorney General Karol V. Mason for the Office of Justice Programs and OVW Principal Deputy Director Bea Hanson have co-authored a blog post<https://n1.m.tt/a/gptkdspqel-ujmgqjdd.html?utm_source=DynamicsMarketing&utm_medium=Email&utm_campaign=JJUVJUST_PediatricSafe_050416> on the importance of the Pediatric SAFE Protocol.
