[MyOEBB] OEBB expanding definition of other coverage eligible for opt-out

Dear Business Managers, Superintendents & Benefits Administrators:

OEBB recently received guidance from the Oregon Department of Justice (DOJ) that we may interpret "employer-sponsored group medical benefit plan" to include TRICARE and Medicare, with the requirement that the employer has a Section 125 cafeteria plan. We are implementing this expanded definition immediately.

Through December 31, 2016, OEBB-participating employers with a Section 125 cafeteria plan may update member enrollments with a retroactive effective date of October 1, 2016, allowing members with TRICARE or Medicare coverage to opt-out of OEBB coverage, and thereby receive a financial incentive in lieu of OEBB coverage, if one is offered.

Please deposit your requested changes in a spreadsheet format in MyOEBB Document Management and also notify us via email at oebb.benefits at oregon.gov<mailto:oebb.benefits at oregon.gov> (so we know you have deposited a document) no later than December 31st.  OEBB will review and make the requested changes.  Please let us know if a retro term does not work for your employees and they desire the opt-out to start effective December 1st.
