The Dallas Downtown Association did a mural on the side of a building in Dallas. There are some factors may want to take into consideration for doing the mural. First off who will own the mural? The DDA actually is the owner of the mural and has a recorded easement on the building. We are responsible for maintaining the mural and keeping it restored. We actually have a designated funds for that mural. The Dallas Downtown Association also was part of a team that did 12 wing murals on buildings downtown. We have agreements with the building owners for the use of the wall for 3-5 years depending on the building owner. We have already lost one of our wing murals because the building was sold and the new owners immediately painted over the mural (it was so sad to see it go!). When the agreements are up, we are responsible to paint over the mural and restore it back to the original condition.
I would not worry about being the judiciary organization on the cost of the mural project, it sounds like a collaboration. I would be more concerned on who will own and maintain the mural. When years go by people tend to forget about the ownership of the mural.

Hi Sheri,
Salem Main Street has been asked to be the non-profit organization to facilitate a large mural art piece on a downtown condominium allowing the contributors to have a tax deduction. Our board wants to support this project and it fits with our mission statement. What we need. is to find out the process to support this request, the legal risks, and how to mitigate the work. We were wondering if you would have information on the "how to” of being their 501(c)(3) tax exempt status on this mural project. We thought there might be guidance from the State level or history of another Main Street city or town that did a similar project.
