Dear HR and Payroll Teams,

Based on shared interest between SEIU and management, effective January 1, 2026, we are reverting the shift differential language back to the wording in the 2023-2025 SEIU Collective Bargaining Agreement. The recent changes that occurred during 2025-2027 negotiations created unintended consequences, including agencies rescinding approved work schedules due to budget impacts and reducing agency flexibility to approve employee-requested schedule changes.

What's Changing:

  * The original language will be reinstated (see below).
  * Agencies can continue granting schedule changes requested by employees without paying shift differential.

As before, employees and managers must continue to manually remove any auto-applied shift differential for employee-requested schedule changes. This is critical because the original reason we negotiated the change was due to inconsistent removal of shift differential, which led to inequities. Ensuring this step happens maintains compliance with the reinstated language. Please ensure this change, along with the requirement to manually remove shift differential for employee-requested schedule changes, is clearly communicated to both employees and managers.

Original Language (2023-2025 SEIU CBA):

Section 5. Shift Differential
(a) Eligibility. All employees required to work a designated schedule shall be paid a differential as outlined in Subsections (b) and (c) below, for each hour or major portion thereof (thirty (30) minutes or more), worked between 6:00 p.m. and 6:00 a.m. and for each hour or major portion thereof worked on Saturday or Sunday. When a work schedule is requested by an employee and approved by the Agency, and the requested schedule contains hours outside of the hours designated for the employee's position by the Agency, shift differential pay shall be waived by the employee for the hours affected by the change.
