RE:    Amended Formula for Significant Disproportionality

This is an update to the Significant Disproportionality notice sent to district and ESD Special Education directors on Tuesday, March 31, 2009.

Oregon's formula for significant disproportionality in the least restrictive environment (LRE) has been amended. The amended document has been reposted at http://www.ode.state.or.us/search/page/?id=653.

The amendment now includes the minimum size (10) for students across all other race/ethnicity categories by setting LRE. By incorporating this amendment, a district will not be triggered for disproportionality in a single racial/ethnic category of students unless there are at least 10 students of other races in that setting. Further questions may be directed to your county contact.
