RE:  Inter-District Transfers for Students in Special Education

With final review and approval of the Special Education Directors Advisory, we are providing you with the new Inter-District Transfer Agreement template.  You requested this prior to the end of March and here it is!

Please note these very important matters regarding the form:

1) A separate inter-district agreement form was developed by the Office of Assessment and Information Services for students who are not on IEPs.  In that agreement, users are told to go no further in completing its contents if the student is on IEP.  It is important that the two forms not be confused, and that you understand this form is the template for students on IEPs involved in inter-district agreement arrangements.

2) This form is not for tuition agreements.  If you have questions about tuition agreements please feel free to contact Mike Wiltfong at micheal.wiltfong at state.or.us<mailto:micheal.wiltfong at state.or.us> .

3) Use of this form is not mandatory. This is a template that has been developed with extensive input and review by the state attorney in the Department of Justice.  You may use it in whole or parts, but we recommend that you have your district legal counsel review any Inter-District Agreement form that you ultimately decide to use.

4) For students on IEPs and involved in an inter-district transfer agreement, the responsibility of providing a free, appropriate education in the least restrictive environment remains with the geographic district of residence.
