From Black’s Law Dictionary (10th edition, the hard copy at my desk ☺):

chilling effect. (1952) 1. Constitutional law. The result of a law or practice that seriously discourages the exercise of a constitutional right, such as the right to appeal or the right of free speech. 2. Broadly, the result when any practice is discouraged. – Also termed chilling bidding; chilling the bidding.

Steve, I believe "chilling effect" is a fairly well-established legal concept.  Here is a citation I found from JSTOR:

That came from just a quick google search--the trick is to look for the info in the legal literature.

Anyone have a good source for a basic definition of 'chilling effect' that could be cited in an academic paper? I'm surprised this is not in the glossary of terms in the Intellectual Freedom Manual. I find all sorts of references to the chilling effect in the literature, but so far nothing that provides a basic definition. Definitions exist in online dictionaries, but I'd prefer a more "substantial" source.
