[OMS_MANAGERS] Right of Way Permits for Outside Dining

We have two programs – a limited duration sidewalk use encroachment permit and a parklet/pedlet encroachment permit. Three docs attached for reference:
Our Limited Duration Sidewalk Use permit agreement/site plan. Applicant submits the site plan with a written request to use the sidewalk and once approved, the agreement letter is sent to them and functions as their permit.
Call for Applications for city-sponsored pedlet program. The City, in conjunction with KFDA and Healthy Klamath, commissioned two pre-fabricated aluminum pedlet units. This program functions as the application process to enter into a competitive process to use one of them during the summer season.
Parklet/Pedlet Manual – Aside from the city-sponsored pedlets, we also allow businesses to provide their own parklet or pedlet. This packet includes the application and manual for that program (this application and manual also covers the city-sponsored pedlets, but as you can see from the call for applications, we want to meet with the business before they apply to assess the basic feasibility of location, street construction near the curb cut, etc.)
All of these documents were created in relatively short order from existing materials, and adapted for use in light of COVID restrictions. We’ve already begun the process of revising for “standard” use, hopefully starting next spring. For example, anywhere you see handwriting will be actually revised in an updated form. 😊
As a side note – one benefit of this program (and a silver lining from this whole COVID experience, if you will, is that Council has essentially granted a limited opportunity for our restaurants to serve alcohol outside their restaurant using shared public space. We’ve been trying to move that direction for a few years, and I think this is the cover they needed to finally try it. We have two pedlets deployed, both serving alcohol, and have had exactly zero problems related to the sale/consumption of alcohol. We (me and my contacts at the City) are moving forward as if this is the new policy. 😊

Our city planner here in McMinnville has asked me to reach out for examples of right-of-way permits cities have issued for outside dining. We are updating our permit process and are looking for examples that address adjustments made for current pandemic conditions. Much appreciated.
