[OSSSA218] More Answers to Questions Raised at Recent Employer Training Events

Good Morning Section 218 Employers:

In the last of the six employer training sessions, there were several questions raised that Chris Cox (Oregon Dept of Revenue) needed to research.  Below are the employer questions with Chris' answers in red.

1.      Are there processing fees which employers are allowed to collect on garnishments?  The employer can charge a processing fee only up to the amount that is allowed on the garnishment. The fee can vary based on who is sending the garnishment.


2.      Is it necessary for the employee to receive a copy of the employer's response to a garnishment? Yes, We are looking into the ability to print the response from ROL (that way employers who want to use ROL to do their responses will not have to also fill out a paper copy to give to the employee).



3.      Does DOR "push" vs "pull" from an employer's account for their payment of STT and other payments they make to Department of Revenue through ROL. For revenue online payments we Pull the payment. (This question was asked because for this employer it was important information for their treasury department.)



4.      We had questions on whether Union Dues and Health Insurance Premiums are Mandatory or Non Mandatory deductions for Garnishment purposes. Sadly we cannot give an answer on this and it is best to consult your entity's department which can give legal advice.



5.      We had questions around employer paid items and if they are subject to STT. These items are added to wages and subject to the other taxes, therefore yes they are subject to STT. The only things that are not subject are Pre Taxed Deductions.
